General terms and conditions of kayak rental

1. Purpose
These terms apply to the rental of pedal fishing kayaks by Joël Percheron, sole trader, operating French Riviera Kayak Fishing (the provider), to any person who makes a booking (the customer). The rental is provided without supervision or guiding. The provider delivers and collects the equipment at the launch point.
2. Booking and deposit
Bookings are made on the website, by phone or via WhatsApp. When a request is made, the kayak or kayaks are held for 48 hours pending the deposit.
The deposit is 30% of the total price. It is paid by bank transfer quoting the reference given. The booking is confirmed by email when the deposit is received. If the deposit is not received in time, the request expires and the slots are released.
Sums paid before the trip are deposits (acomptes).
3. Prices and balance
Prices are shown in euros, per kayak and per slot, with options charged extra. VAT not applicable, art. 293 B du CGI. The balance is paid on the day of the trip, by bank transfer or in cash. No online payment is offered.
4. Security deposit
A security deposit of €3,000 per kayak is required by card imprint through the Swikly service, before departure. Nothing is charged if the equipment comes back in good condition. In the event of damage, loss or theft noted at the return condition check, the provider may charge all or part of the security deposit, up to the actual cost of repair or replacement, on presentation of supporting documents. 5. No right of withdrawal
In accordance with article L221-28 12° du Code de la consommation, the right of withdrawal does not apply to leisure services provided on a set date or for a set period. [À FAIRE VALIDER par un juriste]
6. Cancellation by the customer
The customer may cancel by email or by phone. Cancellation charges: [À COMPLÉTER par Joël].
7. Cancellation by the provider due to the weather
The provider may cancel depending on the marine weather. The customer then chooses another date or gets the full deposit back.
8. Cancellation by the provider for another reason
If the provider cancels for another reason, the provider refunds all sums paid in full.
9. Briefing, instructions and navigation area
The safety briefing is mandatory before each departure. The customer signs a form confirming the briefing, the instructions and the accepted area. This form in no way reduces the provider’s liability as provided by law.
Navigation area: up to 2 nautical miles from a shelter. Beyond that, up to 6 nautical miles, only in daylight, with at least two kayaks and the required equipment. [À FAIRE VALIDER par Joël]
10. Condition check
A condition check is carried out with the customer at departure and on return.
11. Liability and insurance
The provider is responsible for the conformity and good condition of the rented equipment, and for the proper performance of the service, under the conditions provided by law. 13. Mediation
In the event of a dispute, the customer first writes to the provider. If no agreement is reached, the customer may refer the matter to the consumer mediator free of charge: [À COMPLÉTER : nom, adresse, site du médiateur].
14. Applicable law
These terms are governed by French law. A customer who is a consumer keeps the protection of the mandatory rules of their country of residence where the law so provides.
